Break and Enter Lawyer in Brampton, Canada

The offence of breaking and entering occurs when an individual unlawfully enters or attempts to enter private, enclosed property with the intent to commit a serious criminal offence. This typically involves entering a residential or commercial property to steal belongings or cause harm.

The prosecution often seeks maximum penalties upon conviction, which can include fines, restitution, or up to 10 years imprisonment, depending on factors such as the type of structure entered, the extent of damage, injuries sustained, and the value of property stolen or damaged.

348. (1) Every one who

(b) breaks and enters a place and commits an indictable offence therein, or

(c) breaks out of a place after

(i) committing an indictable offence therein, or

(ii) entering the place with intent to commit an indictable offence therein,

is guilty

(d) if the offence is committed in relation to a dwelling-house, of an indictable offence and liable to imprisonment for life, and

(e) if the offence is committed in relation to a place other than a dwelling-house, of an indictable offence and liable to imprisonment for a term not exceeding ten years or of an offence punishable on summary conviction.

How Can You Prove the Crime of Breaking and Entering?

To secure a breaking charge, the prosecutor must prove several elements.

In general, this could include the following:

  • Unauthorized entry;
  • into another’s building or property;
  • with the use of force, deception, or property damage;
  • and without the building and/or property owner’s approval or authorization.

To be prosecuted for breaking in most provinces, the defendant does not have to physically “break” or “force” their way into a property. If the other elements are fulfilled, any unlawfully gained entry into a building may be considered breaking.

As an example, a defendant can be charged with breaking if they climb a tree and enter a second-floor window that has previously been opened without the owner’s permission.

Break & Enter Penalties in Brampton, Canada

This offence is associated with a maximum sentence of ten years imprisonment. The severity of the punishment typically depends on factors such as your prior criminal record and the circumstances of the case. Individuals with a lengthy history of offences will likely face harsher penalties than first-time offenders. It’s essential to have a skilled attorney advocating for your rights in such situations to achieve a favourable outcome.

Frequently, your lawyer can engage in negotiations with the prosecution, potentially leading to a reduced sentence if you plead guilty and avoid taking the case to trial, thereby saving the court’s time.
